The Whisky Index provides information, workflow tools, indicative valuation support, marketplace presentation, document review workflows, and buyer/seller matching support. We do not provide investment, financial, legal, tax, insurance, HMRC, or regulatory advice. Whisky casks are specialist assets and may be illiquid, difficult to verify, difficult to transfer, and may lose value. Nothing on this site guarantees ownership title, warehouse confirmation, transfer completion, buyer demand, sale price, resale timing, profit, or future performance.

These terms apply to your use of The Whisky Index website, tools, forms, marketplace pages, reports, valuation outputs, advisory workflows, buyer matching workflows, seller submissions, and any related services. The Whisky Index is a trading name of THE WHISKY INDEX LTD, company number 17216416, with registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. By using the platform, you agree to these terms. If you do not agree, you should not use the platform.
The platform is designed to help users organise information, assess cask data, review documents, understand potential risks, and express buying or selling interest. Content on the platform is provided for general commercial information and workflow support only. It is not investment advice, financial advice, legal advice, tax advice, insurance advice, HMRC advice, or regulatory advice.
Unless expressly stated in writing, The Whisky Index does not arrange regulated investments, provide regulated investment advice, manage investments, hold client money, operate a regulated exchange, or make financial promotions. Whisky casks should not be treated as risk-free, fixed-return, guaranteed-return, or guaranteed-exit products. Users must make their own decisions and obtain independent professional advice where appropriate.
Valuations, price bands, suggested list prices, fair-value estimates, liquidity scores, readiness scores, market comparisons, exit scenarios, and buyer-demand indicators are indicative estimates only. They may rely on incomplete, third-party, modelled, user-provided, or judgement-led data. They are not guarantees of value, buyer demand, sale price, sale timing, profit, or future performance.
Registry records, verification labels, trust indicators, document statuses, and readiness signals are platform review tools. They do not guarantee legal title, beneficial ownership, warehouse custody, authenticity, completeness, transferability, insurance, tax treatment, or compliance with applicable rules. A record marked as reviewed or verified can still carry commercial, operational, legal, title, provenance, liquidity, or transfer risk.
Whisky cask transactions can depend on warehouse records, delivery orders, duty status, storage terms, insurance, seller authority, buyer suitability, transfer processes, and third-party cooperation. Unless separately agreed in a signed written contract, The Whisky Index does not warrant that a cask exists, is owned by a stated person, is free from encumbrances, is held at a stated warehouse, is insured, is HMRC-compliant, or can be transferred.
Marketplace listings, featured opportunities, buyer briefs, seller leads, reservations, and introductions are subject to review, availability, due diligence, documentation, supplier confirmation, warehouse confirmation, and commercial agreement. We may reject, pause, withdraw, hide, or amend listings, enquiries, or opportunities at any time where we believe this is appropriate for trust, safety, accuracy, compliance, or operational reasons.
You are responsible for checking information before acting on it, providing accurate submissions, keeping your account secure, obtaining professional advice where appropriate, and deciding whether a cask, service, report, listing, buyer, seller, warehouse, or transaction is suitable for you. You must not submit false, misleading, unlawful, confidential, infringing, or unauthorised information.
Where paid reports, advisory services, access, subscriptions, deposits, reservations, or other paid products are offered, the specific price, scope, timing, cancellation position, and refund position should be shown before purchase. Where consumer cancellation rights apply, we will provide required cancellation information. If you ask us to begin a digital or advisory service immediately, cancellation rights may be affected once the service has been fully performed or digital content has been supplied, where permitted by law.
The platform may use or link to third-party tools, including payment processors, analytics providers, CRM tools, communication tools, authentication providers, hosting providers, warehouses, suppliers, and professional advisers. We are not responsible for third-party websites, systems, availability, content, decisions, or terms.
We aim to keep the platform accurate and available, but we do not guarantee uninterrupted access, error-free operation, complete data, or permanent availability of any feature. We may change, suspend, restrict, or withdraw parts of the platform at any time.
Nothing in these terms excludes liability that cannot legally be excluded. Subject to that, The Whisky Index is not liable for losses arising from reliance on indicative valuations, market data, user submissions, third-party information, unavailable buyers, failed transfers, warehouse decisions, tax outcomes, regulatory outcomes, loss of value, loss of profit, loss of opportunity, business interruption, or indirect or consequential losses.
Our use of personal data is explained in the Privacy Policy and Cookies Policy. By submitting forms, enquiries, buyer briefs, seller leads, or registry records, you agree that we may contact you about the relevant request, carry out workflow checks, and process the information as described in those policies.
These terms are governed by the laws of England and Wales, unless mandatory consumer protection rules require otherwise. Disputes will be subject to the courts of England and Wales, unless applicable law gives you a right to bring proceedings elsewhere.
We may update these terms as the platform develops, new services are added, or legal and operational requirements change. Continued use of the platform after updated terms are published constitutes acceptance of the updated terms.
