These terms are between you and THE WHISKY INDEX LTD ("we", "us"), company number 17216416, registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, trading as The Whisky Index (the "Platform").
The Whisky Index is a registry and marketplace for whisky casks. Every cask offered for sale on this platform is our own stock: we are the seller, and the contract of sale for each cask is with us directly, not with another user or an independent third party. The specific terms of a purchase are set out in the Cask Sale Agreement, which forms part of these terms and which you confirm you've read before paying.
You must provide accurate information when registering. Before you can complete a purchase, we confirm your country (to check you can legally buy whisky in your jurisdiction) and the specific cask you're buying. We reserve the right to decline, suspend, or cancel a purchase or account at our discretion, including where we reasonably suspect fraud, misuse, or that a buyer is not legally eligible to buy.
A cask marked "verified" has passed our own checks before it's listed — see How records work for what that covers. This does not constitute a guarantee of value, condition beyond what was checked, or future performance. Nobody, including us, can tell you which cask will rise in value.
We are the seller, so payment is taken through our own account: when your purchase is confirmed, a card payment is authorised and captured, or a bank transfer is accepted, as described at checkout. The price shown is the full amount you pay. Nothing else is added at checkout. Full detail is in the Cask Sale Agreement.
Casks priced over £8,000 include 3 years of storage and insurance at Campbeltown Bond, from the date ownership transfers to you. After that — or for casks at £8,000 or under, from the start — Campbeltown Bond charges its standard rates directly to you, which we confirm before you buy. Either way, we move your cask to Campbeltown Bond at our own cost. Other warehouse services, such as regauging or sampling, aren't included.
Because we are the seller of every cask, we hold your payment and we resolve any dispute about it ourselves. Your right to cancel before and after payment, your EU/EEA 14-day withdrawal right where it applies, and how a dispute is handled are all set out in full in the Cask Sale Agreement. Nothing in these terms removes a statutory right you have by law.

If you believe a listing, a cask's description, or anything else on the Platform is inaccurate, illegal, or breaks our rules, you can report it. No account needed. Every report is reviewed. See our complaints procedure for how we handle a report or a dispute.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
As the seller, nothing in these terms excludes or limits our obligations under the Consumer Rights Act 2015 (for example, that the cask matches its description and is of satisfactory quality) or any other consumer right that cannot be excluded by law. Subject to that, our liability to you for a claim arising from your purchase is limited to loss that directly results from our own breach or negligence in relation to that specific cask. We do not apply a separate fixed monetary ceiling on top of that, and we are not liable for indirect or consequential losses (for example, lost profit or a missed investment opportunity), except where that loss is a foreseeable result of our own breach or negligence.
These terms are governed by the laws of England and Wales.
We may update these terms from time to time. When we do, we will update the version and effective date shown at the top of this page.
