These terms are between you and THE WHISKY INDEX LTD ("we", "us"), company number 17216416, registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, trading as The Whisky Index (the "Platform").
The Whisky Index is a registry and marketplace for whisky casks. We sell as principal: each cask is sourced from our supplier at the point of sale, and the contract of sale for each cask is with us directly, not with another user or an independent third party. The specific terms of a purchase are set out in the Cask Sale Agreement, which forms part of these terms and which you confirm you've read before paying.
You must provide accurate information when registering. Before you can complete a purchase, we confirm your country (to check you can legally buy whisky in your jurisdiction) and the specific cask you're buying. We reserve the right to decline, suspend, or cancel a purchase or account at our discretion, including where we reasonably suspect fraud, misuse, or that a buyer is not legally eligible to buy.
Not every fact on a cask's record has been independently checked by us. Each one is shown as Confirmed (checked against a document or the warehouse), Provided (supplied to us, not yet independently checked), or Not yet (not available yet), see How records work for what each of those means and how we check them. None of this is a guarantee of value, condition beyond what was actually checked, or future performance. Nobody, including us, can tell you which cask will rise in value.
The price shown at checkout is the full price. There are no fees or commissions on top. We are the seller, so payment is taken through our own account, in full, at the moment you buy — a bank transfer instead settles once it reaches us. Our contract for the sale of your cask is formed at that same moment: you pay, and we commit to securing your specific cask (or an agreed sister cask) and registering you as its owner at the warehouse, with a full refund if we can't. The price shown may be in your own local currency, converted from our real GBP price and locked at the moment of purchase — that is the exact amount you pay, and any refund is made in the same currency and amount. Every cask includes 3 years' storage at Castlelaw, from the date you're registered as the owner. Insurance: arranged separately. Castlelaw's cover terms are being renewed. From year 4 you contract with Castlelaw directly, at Castlelaw's current rates, from about £37 to £187 a year including VAT, depending on cask size and storage, and we'll remind you beforehand. We are not VAT registered. Casks are sold in bond, so no VAT or duty is due unless the whisky is removed from bond. Either way, we move your cask to Castlelaw at our own cost. Other warehouse services, such as regauging, sampling, or moving the cask again later, aren't included.
Because we are the seller of every cask, we hold your payment and we resolve any dispute about it ourselves. Your automatic right to cancel for a full refund, paid within 14 days, if we miss our secured/registered promises, your universal 14-day cancellation right after you're registered as owner, and how a dispute is handled are all set out in full in the Cask Sale Agreement. If you live in a different country, the laws of England and Wales apply in addition to, and do not remove or reduce, any mandatory consumer-protection rights you have under the law of the country where you live. Nothing in these terms removes a statutory right you have by law.

If you believe a listing, a cask's description, or anything else on the Platform is inaccurate, illegal, or breaks our rules, you can report it. No account needed. Every report is reviewed. See our complaints procedure for how we handle a report or a dispute.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
As the seller, nothing in these terms excludes or limits our obligations under the Consumer Rights Act 2015 (for example, that the cask matches its description and is of satisfactory quality) or any other consumer right that cannot be excluded by law. Subject to that, our liability to you for a claim arising from your purchase is limited to loss that directly results from our own breach or negligence in relation to that specific cask. We do not apply a separate fixed monetary ceiling on top of that, and we are not liable for indirect or consequential losses (for example, lost profit or a missed investment opportunity), except where that loss is a foreseeable result of our own breach or negligence.
These terms are governed by the laws of England and Wales.
We may update these terms from time to time. When we do, we will update the version and effective date shown at the top of this page.
